240.12b - 5 - Determination of affiliates of banks.

In determining whether a person is an affiliate or parent of a bank or whether a bank is a subsidiary or majority-owner subsidiary of a person within the meaning of those terms as defined in 240.12b2, voting securities of the bank held by a corporation all of the stock of which is directly owned by the United States Government shall not be taken into consideration.
